Perhaps one of the most crucial issues that comes up after getting a divorce is the matter of child custody. In the majority of divorce cases in India, child custody is settled between parents themselves, without the need to go to court. However, if you are among the small number of cases where parents are unable to settle the issue between themselves, then you need to be aware of how Family Courts in India decide on custody issues.

📌Child Prefrences

📌 The age of the children

📌 The mental and physical health of the children

📌 Like if the parents live in seperate countries or are from seperate countries it may result into a lot of legalities and international law compliances to be taken care of

📌 Each parent’s work schedule, to the extent it impacts the amount of time the parent can spend with the children

📌Child's adjustment to school & community

if choosing the joint custody route can both participate in the decision making that surrounds the child’s life. However, if things get ugly, which they sometimes do, and both parents can not agree on what the living arrangements will be for the child/children, then this will be left down to the decision of the courts.
